These Terms of Use ("Terms") govern your access to and use of the Hawaii Discount website, https://www.hawaiidiscount.com ("Site"). By using the Site or placing an order, you agree to these Terms.
1) Who We Are
This website ("Site") is operated by Hawaii Discount (the "Company," "we," "us," or "our"). We offer tours, activities, and tickets ("Activities") made available by independent third-party providers ("Suppliers").
2) We Do Not Operate Activities
Hawaii Discount is a reseller and booking service and does not own, operate, or control the Activities. Suppliers are responsible for providing the Activity, including safety, staffing, equipment, route or itinerary, and compliance with applicable laws. Your contract for the actual Activity is with the Supplier.
3) Bookings, Confirmations, and Payment
When you book, you agree to provide accurate information and authorize us and/or our payment processor to charge the total amount shown, including any applicable taxes and fees disclosed at checkout. A booking is not final until you receive a confirmation or voucher from us. We may refuse or cancel bookings suspected of fraud or misuse.
4) Cancellations, Changes, and No-Shows
Each Activity has its own cancellation and change policy shown on the Activity page and/or voucher, and that policy applies to your booking. No-shows are typically non-refundable. If you need to change or cancel, contact us as early as possible.
5) Pricing and Availability
Displayed prices and availability may change and can include errors. We reserve the right to correct pricing and availability at any time. If a material error affects your booking, we may cancel the booking and issue an appropriate refund, or, where possible, offer options at the correct price.
6) Supplier Changes, Weather, and Force Majeure
Activities may be modified, delayed, rescheduled, or canceled due to weather, ocean conditions, safety concerns, mechanical issues, government actions, or events beyond reasonable control. Refunds or credits, if any, are governed by the Supplier's policy and the terms shown on your voucher.
7) Your Responsibilities
You are responsible for: (a) reviewing your voucher details; (b) arriving on time at the correct location or pick-up point; (c) meeting age, health, and skill requirements; (d) bringing required identification; and (e) following Supplier instructions and safety rules. Some Activities require waivers.
8) Third-Party Links
The Site may link to third-party websites. We do not control them and are not responsible for their content, policies, or practices.
9) Intellectual Property
The Site and its content, including text, design, logos, graphics, photos, and software, are owned by us or our licensors and are protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. No scraping, copying, republishing, or commercial use is allowed without written permission.
10) Prohibited Use
You agree not to: (a) misuse the Site; (b) make speculative, false, or fraudulent bookings; (c) interfere with Site operation; (d) attempt unauthorized access; (e) scrape or harvest data; or (f) upload malicious code.
11) Disclaimer of Warranties
The Site and all information and services are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.
12) Limitation of Liability
To the fullest extent permitted by law, Hawaii Discount will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from a Supplier's acts or omissions.
13) Indemnity
You agree to indemnify and hold harmless Hawaii Discount from claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.
14) Privacy
Your use of the Site is also subject to our Privacy Policy, posted on the Site, which explains how we collect and use information.
